GUEST / COMPANY BOOKING TERMS AND CONDITIONS.

 

  1. Booking Contract: With property owner Susan K. Moore Any reference to you or your refers to the person making the booking. (The Guest and / or the company) as stated on the ‘Booking Confirmation’.

  2. When we issue our booking Confirmation’ the Property Owner enters into a contract with you which is subject to these Booking Conditions. Your statutory rights are not affected by anything contained within these Booking Conditions. You must be aged 21 years or over when booking your accommodation.

  3. The contract between you and the Property Owner is subject to English Law and is formed in Fillongley, Warwickshire, England.

  4. Your booking is made as a consumer and you acknowledge that no liability can be accepted for any business loss howsoever suffered or incurred by you.

  5. The Property Owner has the right to refuse any booking prior to the issue of our written Booking Confirmation. If you are disappointed with the accommodation, you should contact us as soon as possible.

  6. Limits of Liability. There shall be no liability to you or to any member of your party for death or personal injury unless this results from the Property Owner’s act or omission. You must take all necessary steps to safeguard and insure your personal property and no liability to you is accepted in respect of damage to or loss of such property.

  7. If your accommodation is cancelled. We would not expect your accommodation to be cancelled or changed but, if a problem does occur, we will contact you as soon as reasonably possible. The Property Owner cannot be held responsible for cancellation, changes or any other effects on your booked accommodation, due to circumstances beyond our control (force majeure). In such cases the monies paid by you should be refunded.

  8. Security/Booking Deposit. This will be refunded as soon as reasonably possible at the end of your stay, less charges for electricity used,  end of stay service/cleaning if required, and any damage to property.  

  9. Payment of Rent. Rent should be paid in advance by the Guest or Company and by the method stated on the Booking Confirmation.

  10. Your Responsibilities. You are responsible for the payment of the rent by the time stated on the Booking Confirmation or Invoice, keeping the property in a clean and tidy condition or any loss or damage to the property caused by any member of the party. Failure to comply will result in a charge to recover the costs. 

  11. No more people than those stated on the Booking Confirmation are allowed to stay at the property unless permission of the Property Owner has been granted in advance. You cannot allow pets/animals into the property without prior consent. If you do so, the Property Owner can refuse to hand over the property to you or can re-posses the property. Either circumstances will be treated as a cancellation by you and clause 16 will apply.

  12. The Property Owner is entitled to refuse to hand over the accommodation to you or to re-posses the accommodation if he/she reasonably believes that damage has or is likely to be caused by you or your party. This will be treated as a cancellation by you and clause 16 will apply.

  13. The accommodation is in a residential area. Should you or your party cause rowdiness or excess noise or disturbance to other residents, the Property Owner can re-posses the accommodation. These circumstances will be treated as a cancellation by you and clause 16 will apply.

  14. Changes to the Booking by you. If you want to change the date of your accommodation after we have issued a Booking confirmation an administration fee of £35 will be payable to the Property Owner when the change has been made. It is important to realise, however, that we may not be able to change the dates you have booked. In this event, this will be treated as a cancellation by you and clause 16 will apply.

  15. Cancellation Charges. If you cancel your accommodation, you must inform the Property Owner by telephone and email as soon as possible.

    Cancellation charges will be levied as follows:

    1. More than 28 days notice.        No rental charge but an administration fee of  £35 will be payable.

    2. 15 - 27 days notice.                  50% of full accommodation costs or 2 weeks rent, whichever is less.

    3. 0 – 14 days notice.                    100% of full accommodation costs or 2 weeks rent, which ever is less.

  16. Curtailment of the booking by you. If you have to curtail your stay at the accommodation, for any reason, you are required to give 4 whole weeks' notice or pay 4 weeks' rent in lieu of notice.

  17. Right of Access by the Property Owner. You must allow the Property Owner / Caretaker access to the accommodation at any reasonable time during your stay to carry out any maintenance or to Service the accommodation as required.

  18. COMPLAINTS. If there are any problems in respect to the accommodation, it is essential to contact the Property Owner immediately the problem arises so it can be resolved. 

  19. FLEXIBLE BOOKING DATES: Accommodation may be booked on a flexible basis and constantly extended, provided a minimum of 4 weeks' notice is given to terminate the booking, or full payment of rent made in lieu of notice.

  20. CANCELLATION DUE TO COVID RESTRICTIONS. A full refund (or pro rata) will be given.
